Proview Files iPad Trademark Lawsuit in U.S.

Last week, Proview filed a trademark lawsuit in California against Apple and requested that the Court issue a ruling to prevent Apple from using the iPad name in the United States.? Apple claims that Proview sold the rights to the iPad trademark to Apple.? Proview claims that an Apple subsidiary, IP Application Development, Ltd. (IPAD), made false statements before the sale that induced Proview into selling the iPad trademark.? Based upon that allegation, Proview has also asked the California Superior Court to nullify the sale of the iPad trademark. Prior to last week?s ruling in Shanghai, Proview had announced that it was ready to enter into settlement negotiations with Apple.? Apple chose to proceed with the court hearing wherein the Shanghai Court denied Proview?s demand to block the sales of iPads in Shanghai. One has to wonder if the California lawsuit is another attempt by Proview to obtain a quick settlement from Apple. With so much at stake for Apple as to the iPad name, it will be interesting to see if Apple will fight or entertain a settlement proposal.
