Maverick Couch, a high school student in Waynesville, Ohio, sued for the right to wear his "Jesus Is Not A Homophobe" T-shirt.

Maverick Couch can wear his ?Jesus Is Not?a Homophobe? T-shirt to school again ? without fear of being suspended.

The 16-year-old junior at Waynesville High School in Ohio has won a legal fight to wear the shirt, which was a gift from a friend?s aunt, on school grounds.

?I?m really blessed and happy,? he told msnbc.com on Tuesday, a week after he learned of a court action in his favor. ?It?s just really amazing. I never thought it would come out like this.?


In the judgment entered May 21, U.S. District Judge Michael Barrett ordered school officials to allow Maverick to wear the T-shirt to school whenever he chooses. He also ordered the school district to pay $20,000 in damages and court costs to the teen.

?We?re very happy for Maverick and all LGBT students in Ohio,? Christopher Clark, senior staff attorney for Lambda Legal, which sued on Maverick?s behalf, said in a press release. ?If school officials had any doubt before, it?s clear now: First Amendment rights apply to all students on every day of the year, and efforts to silence LGBT youth will not go unchallenged.?

The settlement ends a legal fight that began a little more than a year ago.

According to court documents, Couch wore the T-shirt with a rainbow-colored Ichthys, or ?sign of the fish,? and lettering that read ?Jesus Is Not a Homophobe? to school in April 2011 in observation of the Gay, Lesbian & Straight Education Network?s ?Day of Silence.?

The principal, Randy Gebhardt, called Maverick into his office and instructed him to turn the shirt inside-out. Maverick complied. He wore the T-shirt to school again the next day. This time, his mother was called in and he was told to remove the T-shirt or face suspension. Maverick again complied.

When school resumed in the fall, Maverick asked the principal for permission to wear the T-shirt. Again, he was told he would be suspended if he did so. That?s when he and his mother turned to lawyers.

In January, Lambda Legal sent the school district a letter outlining Maverick?s First Amendment rights and stating he had the right to wear the shirt. The school district responded that ?the message communicated by the student?s T-shirt is sexual in nature and therefore indecent and inappropriate in a school setting.?

The school district?s response continued:

?Wayne Local School District Board of Education had the right to limit clothing with sexual slogans, especially in light what was then a highly charged atmosphere, in order to protect its students and enhance the educational environment. Consequently, the high school principal was well within the bounds of his authority to request that the student remove his T-shirt and refrain from wearing the T-shirt in the future.?

Last month Lambda Legal sued the Wayne Local School District on Maverick?s behalf, contending the district was violating the teen?s First Amendment right to free speech.

?I just wanted to wear my shirt,? Maverick was quoted as saying in?a Lamda Legal?press release last week announcing the court settlement. ?The shirt is a statement of pride, and I hope other students like me know that they can be proud, too.?

The $20,000 that the school district has been ordered to pay will be covered by Wayne Local Schools? insurance policy.

Superintendent Patrick Dubbs didn?t immediately return a phone call for comment on Tuesday. He earlier told the Student Press Law Center that the lawsuit, filed in April, came as a surprise.

?I would even question the tactics used because we were never told we were being sued,? Dubbs was quoted as saying by SPLC. ?Our feeling was this never had to go to federal court. All of our actions all along, once we became aware of Lambda Legal, were that we never wanted to go to court.?

As for Maverick, he says he wore the T-shirt to school the day after he learned of the court judgment in his favor.

?I really didn?t get any reaction,? he told msnbc.com. "I had a few friends ask me, ?Has anything happened?? It was like any other day. The principal didn?t say a word.?

He says he plans to wear the shirt to school again in the fall when classes resume.

The message,?Maverick says, is all about tolerance.

"We need to accept others how they come no matter their religion, sexual orientation, the color of their skin. Everyone is who they are. We all need to come together as a whole and accept everyone.?

Successful test at PTB of optical magnetometer with potential applications in brain imaging for neurological diagnostics and in basic research

In future a new magnetic sensor the size of a sugar cube might simplify the measurement of brain activity. In the magnetically shielded room of Physikalisch-Technische Bundesanstalt the sensor has passed an important technical test: Spontaneous as well as stimulated magnetic fields of the brain were detected.

This demonstrates the potential of the sensor for medical applications, such as, the investigation of brain currents during cognitive processes with the aim of improving neurological diagnostics. The main advantage of the new sensor developed by NIST in the USA over the conventionally used cryoelectronics is its room temperature operation capability making complicated cooling obsolete. The results have recently been published in the journal Biomedical Optics Express.

The magnetic field sensor is called Chip-scale Atomic Magnetometer (CSAM) as it uses miniaturized optics for measuring absorption changes in a Rubidium gas cell caused by magnetic fields. The CSAM sensor was developed by NIST (National Institute of Standards and Technology), which is the national metrology institute of the USA. In this cooperation between PTB and NIST each partner contributes his own particular capabilities. PTB's staff has long standing experience in biomagnetic measurements in a unique magnetically shielded room. NIST contributes the sensors, which are the result of a decade of dedicated research and development.

Up to now the measurement of very weak magnetic fields was the domain of cryoelectronic sensors, the so called superconducting quantum interference device (SQUID). They can be considered as the gold standard" for this application, but they have the disadvantage to operate only at very low temperatures close to absolute zero. This makes them expensive and less versatile compared to CSAMs. Even though at present CSAMs are still less sensitive compared to SQUIDs, measurements with a quality comparable to SQUIDs, but at lower costs, might eventually become reality. Due to the cooling requirements, SQUIDs have to be kept apart from the human body by a few centimeters. In contrast to that, CSAMs can be attached closely to the human body. This increases the signal amplitude as the magnetic field from currents inside the human bodydecays rapidly with increasing distance.

An important application is the measurement of the magnetic field distribution around the head, which is called magnetoencephalography (MEG). It enables the characterization of neuronal currents. Such investigations have gained importance during the last few years for neurologists and neuroscientists. Objective indicators of psychiatric disorders as well as age dependent brain diseases, are urgently needed for the support of today's clinical diagnostics.

Already in 2010 scientists from NIST and PTB had successfully tested the performance of an earlier version of the present CSAM by measurements of the magnetic field of the human heart. For the present study the sensor was positioned about 4 mm away from the head of healthy subjects. At the back of the head, the magnetic fields of alpha waves were detected, a basic brain rhythm which occurs spontaneously during relaxation. In another measurement the brain fields due to the processing of tactile stimuli were identified. These fields are extremely weak and the CSAM result was validated by a simultaneous MEG measurement relying on the established SQUID technology. if/ptb

Study: Fake malaria drugs common in Asia, Africa

HANOI, Vietnam (AP) ? More than a third of the malaria-fighting drugs tested over the past decade in Southeast Asia and sub-Saharan Africa were either fake or bad quality, seriously undermining efforts to fight the disease, a study said Tuesday.

With up to 1 million people ? mostly children in Africa ? already dying every year from malaria, bogus drugs and those containing the wrong chemical makeup could upend a decade of progress fighting the mosquito-transmitted disease, the U.S.-funded review said.

International efforts to combat drug counterfeiting ? much of it believed to take place in China ? are urgently needed.

Fake drugs with no malaria-fighting agents can lead to deaths when patients rely on them, and those containing some active ingredients ? but not enough to fully kill all parasites ? are also problematic because they promote resistance that can eventually outsmart medicines and render them useless.

Alarm bells have sounded in recent years over signs of increasing resistance in western Cambodia on Thailand's border with Myanmar among artemisinin-based drugs, the only effective medicine now widely used to cure the disease.

Studies show the drugs are taking longer to work there, and experts fear the emerging resistance could eventually spread to Africa as has occurred previously with other malaria treatments that now are worthless against the disease.

If artemisinin-based drugs stop working, there is no good replacement and many people would ultimately die. Currently, malaria kills an estimated 2,000 children every day in Africa. Some 3.3 billion people worldwide are at risk of getting infected.

"We feel a sense of emergency considering the impact these medicines can have," lead author Gaurvika Nayyar, of the Fogarty International Center at the U.S. National Institutes of Health, said in an email.

The study says more labs are needed worldwide to test for fake drugs ? only three out of 47 malaria-plagued countries in Africa are equipped to do so. Nayyar also calls for counterfeiters to be brought to justice, including the creation of a universal way to crack down on those involved in the cross-border trade. Currently, laws only exist within individual countries.

"The economic incentives for criminals of drug falsification surpass the risks involved in their production and sale," the authors wrote in the article published in the Lancet Infectious Diseases journal.

"Production and distribution of counterfeit antimalarial drugs should be prosecuted as crimes against humanity," they added.

The review analyzes 27 published and unpublished studies dating back to 1999 that look at poor-quality and counterfeit malaria-fighting drugs.

In Southeast Asia, various anti-malaria drugs were analyzed from seven countries from 1999 to 2010. Of 1,437 samples, 35 percent contained the wrong chemical makeup; nearly half of 919 samples were incorrectly packaged; and 36 percent of 1,260 samples were fake.

In Africa, 35 percent of 2,297 samples collected from 21 countries had the wrong amount of chemicals; 36 percent of 77 failed packaging testing, and 20 percent of 389 drugs were fake.

The authors said many cases go unreported. They also point to other issues driving the problem, such as patients buying drugs over the country without prescriptions and self-medicating along with using drugs that are expired or degraded through improper storage.

Earlier studies found indications that some counterfeits were made in China and smuggled into Southeast Asia, but more research is needed to understand the extent and complexities of the problem.

Blind Chinese activist may soon depart for U.S.

BEIJING (Reuters) - Blind Chinese legal activist Chen Guangcheng said on Saturday he had left a hospital in Beijing and was at the airport where he expected to be departing for the United States, a move that would signal the end of a diplomatic crisis between the two country.

Chen, who has been in hospital for the past three weeks since he sought refuge in the U.S. embassy, said he believed he would be headed on a flight to the United States, but added he was still uncertain of it. The U.S. embassy was not immediately available for comment.

Chen's escape from house arrest in northeastern China last month and subsequent refuge in the U.S. embassy caused huge embarrassment for China, and led to a serious diplomatic rift while U.S. Secretary of State Hillary Clinton was visiting Beijing.

Chen told Reuters by telephone: "I'm at the airport now. I've already left the hospital. But there are many things that are still unclear."

Chen said that his wife and two children were at the airport with him, accompanied by hospital staff.

Two police cars were stationed below the walkway to the plane Chen was expected to board, and about 10 security officials in plainclothes circulated around the airport.

Several photographers were in position at the waiting area, but passengers at the gate to Chen's flight appeared not to know that he would be on the same flight.

"Yes, I might be heading for a flight to the United States, but I haven't been told, and I haven't received our passports, so I'm not sure yet," Chen said. "We're waiting to find out what's happening."

DRAMATIC ESCAPE

The development came about three weeks after Chen arrived at the Chaoyang Hospital from the U.S. embassy, where he had taken refuge after a dramatic escape from 19 months under house arrest in his home village.

Chen's confinement, his escape and the furore that ensued have made him part of China's dissident folklore: a blind prisoner outfoxing Communist Party controls in an echo of the man who stood down an army tank near Tiananmen Square in 1989.

In 2006, Chen was sentenced to more than four years in jail on charges - vehemently denied by his wife and lawyers - that he whipped up a crowd that disrupted traffic and damaged property.

Chen had led campaigns for farmers and disabled citizens and exposed forced abortions.

He was formally released in 2010 but remained under house arrest in his home village in northeastern Shandong province, which officials turned into a fortress of walls, security cameras and guards in plain clothes who kept Chen isolated.

The village of Dongshigu, where Chen's mother and other relatives remain, is still under lockdown.

The U.S. embassy had earlier thought it had stuck a deal to allow Chen to stay in China without retribution, but that fell apart as Chen grew worried about his family's safety. He changed his mind about staying in China and asked to travel to the United States.

Human rights are a major factor in relations between China and the United States, even though Washington needs China's help on issues such as Iran, North Korea, Sudan and the fragile global economy.

Chen Guangcheng's nephew, Chen Kegui, was denied his family's choice of lawyers on Friday to defend a charge of "intentional homicide", the latest in a series of moves to deny him legal representation, and underscores the hardline stance taken against Chen Guangcheng's family. (nL4E8GI4F0)

'Superflares' from stars counted

Nasa's Kepler space telescope has provided fresh insight on the colossal explosions that can afflict some stars.

These enormous releases of magnetic energy - known as superflares - could damage the atmosphere of a nearby orbiting planet, putting at risk any lifeforms that might reside there.

Fortunately, Kepler shows superflares to be much less frequent on slow-rotating stars like our Sun.

The new observations are reported in the journal Nature.

The biggest recorded flare on the Sun was probably the "Carrington event" of 1 September 1859.

Described by the English astronomer Richard Carrington, this outburst sent a surge of electromagnetic radiation and charged particles towards the Earth.

The magnetic fields embedded in the bubble of matter buffeted the Earth's own magnetic field, producing spectacular auroral lights. Electric fields generated in telegraph wires disrupted communications.

Remarkably, a Carrington flare is puny compared to some of the events witnessed by Kepler. These superflares can be 10,000 times more energetic.

The US space agency telescope is currently staring at 100,000 stars in a patch of sky about 600 to 3,000 light-years from Earth.

It is looking for tell-tale dips in light that might indicate orbiting planets have just moved across the face of those stars. But in making those observations, Kepler is also gathering information on the sudden brightening that might be associated with flares.

Hiroyuki Maehara from Kyoto University, Japan, and colleagues have now reviewed the data to compile the best statistics yet on the frequency and size of superflares.

Kepler saw a total of 365 superflares during an observation period lasting 120 days.

The numbers confirm that very few (only 0.2%) Sun-like stars experience monster flares.

That may be explained by current models which indicate superflares could be caused by magnetic interactions with closely orbiting giant planets - not something we see in our Solar System, where the largest worlds, Jupiter and Saturn, circle far away from the Sun.

But, this is a situation seen in some distant planetary systems where worlds even bigger than our gas giants orbit extremely close to their host stars.

One other interesting observation Kepler makes is that the stars which have superflares display extremely large starspots.

These are regions of the star's surface that are relatively cooler than the typical surface temperatures around them.

Carrington famously sketched the spot group on the Sun associated with his big flare, but according to Kepler this group would be dwarfed by the sort of spots on a superflare star.

Scientists have long speculated about the impact of a superflare on our Sun might have on Earth. The expectation is that it would strip away the ozone layer, leading to increased radiation at ground level. Widespread extinctions could result.

There is a flip side to this, however. In some distant planetary systems, superflares might actually be life-enabling by providing sufficient energy in the atmospheres of these worlds to initiate the chemistry necessary for biology to get going.

War crimes judges hear Taylor's sentencing pleas

LEIDSCHENDAM, Netherlands (AP) ? Former Liberian President Charles Taylor is to address judges personally during the sentencing hearing of his war crimes trial Wednesday, asking for leniency even as he plans to appeal his conviction.

In a landmark ruling in April, judges at the Special Court for Sierra Leone found Taylor guilty of 11 counts of war crimes and crimes against humanity, including murder, rape, and conscripting child soldiers. Judges at the U.N.-backed court said his aid was essential in in helping rebels across the border in Sierra Leone continue their bloody rampage during the West African nation's decade-long civil war, which ended in 2002 with more than 50,000 dead.

The court found Taylor helped the rebels obtain weapons, knowing they would likely be used to commit terrible crimes, in exchange for payments of "blood diamonds" often obtained by slave labor. It was the first time a former head of state had been convicted for war crimes since the aftermath of World War II.

In pre-hearing briefs, prosecutors demanded an 80-year sentence, saying Taylor made horrific crimes possible.

"The purposely cruel and savage crimes committed included public executions and amputations of civilians, the display of decapitated heads at checkpoints, the killing and public disembowelment of a civilian whose intestines were then stretched across the road to make a check point, public rapes of women and girls, and people burned alive in their homes," wrote prosecutor Brenda Hollis.

Defense attorney Courtenay Griffiths argued for a sentence reflecting Taylor's indirect role: he was found guilty only of aiding the rebels, not leading them as prosecutors charged.

Griffiths said the recommendation is "manifestly disproportionate and excessive" for Taylor, who is 64.

In a pre-hearing brief Griffiths argued that "an appropriate penalty would be a number of years which falls short of what would be in real terms a life sentence."

The sentence is due May 30.

In court, Hollis scoffed at the idea that the 80-year demand was excessive. She said Taylor's involvement in the crimes was "more pervasive than that of the most senior leaders" of the rebels who have already been sentenced. The longest sentence so far, 52 years, was given to rebel leader Issa Sesay, who testified on Taylor's behalf in 2010.

The biggest unknown Wednesday is what to expect from the always impeccably dressed Taylor, who has already proven himself a capable speaker in court. In seven months of testimony in his own defense, he cast himself as a peacemaker and statesman in West Africa. His lawyers said he deserved a lesser sentence for his diplomacy.

But Hollis said Taylor continued to fund rebels privately even as he publicly lobbied for peace in Sierra Leone.

"Mr. Taylor should be given no credit for acting as a two-headed Janus," she said.

During his trial, Taylor insisted he was an innocent victim of neocolonialism and a political process aimed at preventing him from returning to power in Liberia. He listened to Hollis attentively on Wednesday but with little expression, leaning forward, hands clasped.

On Wednesday he may apologize and try to show remorse in hopes of a more lenient sentence. But until now he has maintained his innocence of wrongdoing, and his lawyers plan to appeal the conviction.

Taylor fled into exile in Nigeria after being indicted by the court in 2003 and wasn't arrested for three years. While the Sierra Leone court is formally based in that country's capital, Taylor's trial is being staged in Leidschendam, a suburb of The Hague, Netherlands, for fear holding it in West Africa could destabilize the region.
